Terms of Use
Version 3.4 · Effective 2026-09-01
Effective date: September 1, 2026. Governing law: State of North Carolina. Company: LKN Concierge LLC, a North Carolina limited liability company (the "Company," "LKN Concierge," "we," or "us"), with mailing address at [PO BOX PLACEHOLDER — e.g., PO Box XXX, Mooresville, NC 28117]. Registered office and agent for service of process in North Carolina: [Registered agent street address — required by N.C. G.S. 55D-30; use a commercial registered agent's NC street address].
This packet contains two agreements used for LKN Concierge bookings. Use Part A when the person receiving care is a minor (under 18). A parent or legal guardian must sign Part A. Use Part B when an adult caregiver or an adult family-account holder accepts platform and engagement terms. LKN Concierge is a childcare marketplace only; bookings for care of an adult are outside the scope of the service and are not permitted. Both parts should be presented in-app before the first booking and re-accepted when material terms change.
IMPORTANT — NOT LEGAL ADVICE. This is an operational template drafted for a North Carolina marketplace. It is not a substitute for advice from a North Carolina-licensed attorney. Have counsel review before you collect signatures, especially the waiver, indemnity, independent-contractor, arbitration, medical-authorization, and consumer-reporting language. North Carolina courts construe liability releases strictly and will not enforce a release of gross negligence, willful or wanton conduct, or intentional wrongdoing.
How these documents fit the LKN Concierge model
LKN Concierge is a local marketplace and booking platform. It is not a licensed child-care facility, and does not employ sitters or nannies.
Caregivers are independent contractors. The family (or adult client) hires the caregiver. The Company facilitates discovery, booking, payments, and safety tools.
Caregivers on the platform must be 18 or older, complete identity verification, and complete the required background check before becoming fully active.
Most casual, in-home babysitting for one family is not "child care" under G.S. 110-86 and is not licensed by the N.C. Division of Child Development and Early Education. Recurring care of three or more unrelated children under 13, away from the children's home, for more than four hours at least once per week, can trigger licensing. Families and caregivers must not use the platform to operate an unlicensed child-care arrangement.
Registered sex offenders may not provide a "baby sitting service" as defined in G.S. 14-321.1. The Company will remove any caregiver who is a registered sex offender.
The Company does not employ, recommend, or endorse any caregiver, and does not train, manage, supervise, or oversee services provided by any caregiver. Caregiver profiles, ratings, and search rankings are not endorsements. Care Seekers retain sole and exclusive decision-making authority over which caregivers to interview, screen, and hire, and over whether to continue an engagement.
The Company is not a consumer reporting agency under the federal Fair Credit Reporting Act (FCRA) or any state analog, is not an employment agency, is not a nurse registry under N.C. G.S. 131E-154.2, and is not a licensed home care agency under N.C. G.S. 131E-136. The Company does not provide medical, nursing, hospice, or licensed home-health services.
Defined terms — parent company and affiliates
[UPDATED — parent-company definition, filed-record references] In these Terms, "parent company" means the entity identified as the sole or controlling member of LKN Concierge LLC (i) in the Company's Articles of Organization filed with the North Carolina Secretary of State on August 31, 2026, and (ii) in the Company's current North Carolina operating agreement on file with the Company, in each case as such filings may be amended or restated from time to time. If those documents differ, the most recently filed or executed controls. "Affiliates" means any entity that controls, is controlled by, or is under common control with LKN Concierge LLC or its parent company, where "control" means ownership of more than fifty percent (50%) of the voting or economic interests, or the power to direct management and policies. The Company will confirm the identity of its parent company on written request from a party with a legitimate legal need (for example, a plaintiff's counsel confirming released parties, a court of competent jurisdiction, a regulator, or a bank or insurer conducting diligence). Certified copies of the filed Articles of Organization are available from the North Carolina Secretary of State's business-entity records at sosnc.gov. The Company is not required to publish the parent company's name in these customer-facing Terms, and the absence of that name does not limit the release, indemnity, and other protections that run in favor of the "Company Parties" as defined in Section A7.
PART A — Parent / Legal Guardian Terms (Care of Minors)
This Part A is an agreement among (1) the parent or court-appointed legal guardian who signs below ("Guardian"), (2) the independent caregiver booked through LKN Concierge ("Caregiver"), and (3) LKN Concierge LLC, solely in its role as marketplace operator. By signing or tapping "I Agree," Guardian acknowledges that Guardian has authority to bind every parent or guardian with legal custody of each child listed, and that Guardian has read and accepts these terms.
A1. Children covered
List every child who may receive care under this authorization. Add rows as needed. A new child requires an updated signature or in-app confirmation.
Each child listed above is a "Child." Guardian represents that Guardian is the Child's parent or legal guardian and has authority to consent to in-home or agreed-location care, emergency medical treatment, and the releases in this Part A.
A2. Nature of the service
Services are occasional babysitting or recurring nanny-style care booked through the LKN Concierge app, performed at the address specified in the booking (usually the family's home in the Lake Norman area) or another location Guardian approves in writing in the app.
Caregiver provides supervision, age-appropriate activities, meals or snacks only as Guardian authorizes, light household tasks related to the children, and homework help if agreed. Caregiver is not a licensed teacher, nurse, therapist, or medical provider unless separately disclosed and credentialed.
Caregiver will not transport a Child unless Guardian has separately authorized driving in the booking and Caregiver holds a valid driver's license and required insurance. Caregiver will not leave a Child under eight years of age unsupervised, consistent with North Carolina fire-code guidance on unsupervised children.
Overnight care, swimming, baths, medication administration, and off-site activities require specific written or in-app authorization for that booking.
Excluded services. The platform is not for finding or managing care requiring a license or certification (skilled nursing, respiratory therapy, behavioral therapy billable to insurance, licensed daycare, licensed teaching), care for children with special medical needs unless the Caregiver's profile expressly credentials that specialty, or house cleaning, tutoring, or educational services beyond ordinary homework help.
A3. Guardian duties
Provide complete, current information: allergies, medications, physicians, insurance, emergency contacts, custody or pickup restrictions, behavioral notes, and house rules.
Disclose hazards at the care location (pool, firearms, pets, medications, water features, unfinished construction). Secure firearms, medications, alcohol, and toxic substances before the booking starts.
Be reachable during the booking. Name at least two emergency contacts who can assume custody if Guardian cannot be reached.
Return at the booked end time. Pickup is due at the booked end time shown in the booking. Time after that end time is late pickup. Late pickup is billed in 30-minute increments at the Caregiver's booked hourly rate shown at checkout and on the booking confirmation. The app will send a reminder before the booked end time. After the booked end, the Caregiver confirms the actual pickup time in the app, and Guardian will see any late-pickup increment and dollar amount before it is charged. A booking that runs more than 30 minutes past the scheduled end without notice in the app may be billed in additional 30-minute increments. If the late-pickup rate was not shown on the booking Guardian accepted, it will not be charged.
Pay the booked rate through the LKN Concierge payment system (Stripe Connect). Do not take payments off-platform for bookings originated on LKN Concierge.
Do not ask Caregiver to operate an arrangement that would require a North Carolina child-care license if Guardian and Caregiver are not licensed.
Household-employer awareness. Guardian understands that if a recurring engagement causes the Caregiver to meet the IRS 'household employee' test (Publication 926) or exceed the annual FICA wage threshold, Guardian, not the Company, is responsible for withholding, issuing Form W-2, paying employer FICA, obtaining North Carolina unemployment insurance (N.C. G.S. Chapter 96), and any workers' compensation coverage required by N.C. G.S. Chapter 97. Guardian releases the Company from claims arising from Guardian's failure to meet these employer obligations.
A4. Caregiver duties
Exercise the care a reasonably careful adult would use when supervising children of the same ages in the same circumstances.
Follow Guardian's written instructions, house rules, and any safe-sleep instructions for infants 12 months or younger (place infants on their backs to sleep unless a health-care professional has provided a written waiver consistent with accepted safe-sleep practice; no loose bedding, pillows, or positioners unless a qualifying waiver exists).
Remain awake and present for non-overnight bookings. For overnight bookings, remain in the home and check on children as agreed.
Not use corporal punishment, humiliation, or withholding of food, water, or needed care as discipline.
Not invite visitors, photograph or post the Child on social media, or use the Child's image except as Guardian authorizes in A8.
Notify Guardian promptly of injury, illness, unusual behavior, property damage, or a safety concern. Call 911 first when a reasonable person would treat the situation as an emergency.
A5. Emergency medical authorization (minors)
If, in Caregiver's reasonable judgment, a Child needs emergency medical, dental, or surgical care and Guardian cannot be reached in time, Guardian authorizes Caregiver and any licensed health-care provider to consent to evaluation and treatment that a reasonably prudent parent would authorize in the same emergency. This includes transport by EMS. Guardian remains financially responsible for the Child's medical costs. This authorization does not require Caregiver to administer non-emergency medication.
Non-emergency medication (prescription or over-the-counter) may be given only if Guardian has provided written or in-app instructions that identify the Child, medication, dose, route, time, and last dose. Caregiver may refuse to administer medication that instructions do not clearly support.
A6. Pickup and custody
Caregiver will release a Child only to Guardian or to a person Guardian named in the booking as an authorized pickup. Caregiver may request photo identification. If an unauthorized person demands pickup, Caregiver will not release the Child and will contact Guardian and, if needed, law enforcement. Guardian must disclose any custody order, protective order, or person who is not permitted contact. LKN Concierge is not a party to custody disputes and will follow the written instructions Guardian provides in the app.
A7. Assumption of risk, release, and limitation of claims — READ CAREFULLY
Guardian understands that childcare involves inherent risks, including falls, choking, allergic reaction, illness, emotional distress, and injuries from ordinary play, household conditions, pets, pools, and other children. Guardian accepts those ordinary risks on behalf of Guardian and each Child.
TO THE MAXIMUM EXTENT PERMITTED BY NORTH CAROLINA LAW, Guardian, for Guardian, the Child, and their heirs and assigns, releases and agrees not to sue LKN Concierge LLC, its parent company, and their respective affiliates, subsidiaries, members, managers, officers, directors, employees, contractors, and agents (the "Company Parties") from claims arising out of or related to a booking, including claims of ordinary negligence in operating the marketplace (matching, messaging, payments, background-check facilitation, and related tools).
THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL OR WANTON CONDUCT, OR INTENTIONAL MISCONDUCT. North Carolina law does not permit a pre-injury waiver of those claims. Nothing in this Part A limits a claim against a Caregiver for the Caregiver's own negligence or misconduct. The Company does not waive any defense, including that caregivers are independent contractors and that the Company did not control the manner of in-home care.
Guardian acknowledges North Carolina's contributory-negligence rule: if Guardian's own negligence contributed to an injury, recovery against another party may be barred.
Aggregate cap. To the maximum extent North Carolina law allows, the Company Parties' total aggregate liability to Guardian and each Child, for all claims arising out of the platform or any booking in any twelve-month period, will not exceed the greater of the fees Guardian paid the Company in the twelve months before the claim and five hundred dollars ($500). This cap does not apply to liability that cannot be limited under North Carolina law (including gross negligence, willful or wanton conduct, intentional torts, and any statutory right that expressly forbids waiver).
A8. Photos, video, and privacy
Guardian checks one option for each booking default (Guardian may change this in the app):
Caregiver may take photos or short video of the Child only to send privately to Guardian through the app during the booking, and must delete local copies when the booking ends unless Guardian asks to keep a copy.
Caregiver may not photograph or record the Child at all.
Neither Caregiver nor the Company may use a Child's image in marketing without a separate written media release. The Company may retain booking records, messages, and safety reports as described in the Privacy Policy.
A9. Background checks and no guarantee of safety
The Company requires identity verification and a third-party background check (currently Checkr Essential for nanny/babysitter roles) before a caregiver is fully active. A background check is a point-in-time search of available records. It is not a warranty that a Caregiver is safe, honest, or skilled. Guardian remains responsible for interviewing, checking references, conducting a meet-and-greet, and deciding whether to book. The Company is not a consumer reporting agency and does not provide consumer people-search reports.
FCRA and CRA disclosures. Background checks are performed by a third-party consumer reporting agency and are 'consumer reports' under the federal Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). Reports may include criminal, sex-offender registry, motor vehicle, and identity information. Care Seekers who order a report authorize its release to them from the reporting agency; Caregivers who submit to a report authorize its release to the Company and to any Care Seeker who requests it. The Company does not guarantee accuracy, completeness, currency, or reliability of any consumer report and is not responsible for the reporting agency's databases or coverage gaps (background checks may miss offenses not in the databases searched). Disputes about report contents must be raised with the reporting agency directly under the FCRA. If the Company denies or terminates access based on a report, the Company will identify the reporting agency and give the affected user the FCRA-required contact information and access rights.
Ongoing preliminary screening. Caregivers consent to ongoing periodic preliminary screens and re-checks through the third-party reporting agency during the entire time their account is active, including sex-offender registry monitoring. The Company may suspend or remove any Caregiver based on preliminary-screen results, and is not required to reinstate an account even if the underlying record is later corrected.
A10. Mandatory reporting and disappearance of a child
If Caregiver or the Company reasonably suspects child abuse or neglect, they may report to the county department of social services and law enforcement. Guardian will not retaliate for a good-faith report. If a Child under 16 disappears during a booking, Caregiver must notify law enforcement immediately as required by G.S. 14-318.5 and then notify Guardian and the Company.
North Carolina universal-reporter statute. Under N.C. G.S. 7B-301, any person or institution with cause to suspect that a juvenile is abused, neglected, or dependent must report to the county department of social services. Every Caregiver on the platform acknowledges this duty and agrees to make a report when the statute requires it, in addition to any report to the Company.
A11. Cancellation, no-show, and payment
Cancellation windows and fees are those displayed at checkout for that booking.
If Guardian is a no-show or cancels inside the fee window, the posted fee may be charged.
If Caregiver cancels, Guardian will receive a refund of amounts paid for the cancelled booking and the Company will help find a replacement when reasonably available. The Company is not liable for consequential damages from a cancellation (missed event, lost wages).
Tips are optional and go to the Caregiver. Platform and processing fees are disclosed at checkout.
Caregiver cancellation window. A Caregiver may cancel a booking up to 24 hours before the scheduled start without penalty. Cancellations inside 24 hours may result in reduced payouts, reduced search visibility, or account review, in the Company's discretion.
No-show and booking filings. Guardian must report a Caregiver no-show, and may file any other claim about that booking (refund, booking-tied conduct, or dispute), in the app under Account, then Cases, within seventy-two (72) hours of the booked end time. That single 72-hour window is the filing deadline the app will enforce. If Guardian cannot sign in, email hello@lkn-concierge.com as a fallback. The timestamp in Cases controls.
A12. Indemnity by Guardian
Guardian will defend and indemnify the Company Parties against third-party claims arising from (a) Guardian's breach of this Part A, (b) inaccurate information Guardian provided, (c) hazards at the care location that Guardian did not disclose, and (d) disputes among parents, guardians, or household members. This indemnity does not cover the Company Parties' gross negligence or willful misconduct.
A13. Term, electronic signature, governing law
This Part A stays in effect for all bookings of the listed Children until Guardian revokes it in the app or in writing, and it covers each booking Guardian confirms. Electronic acceptance (checkbox, tap-to-sign, or typed name) is a valid signature under the North Carolina Uniform Electronic Transactions Act. North Carolina law governs. Exclusive venue is the state courts of Catawba County, North Carolina, or the federal court for the Western District of North Carolina, unless the Company and Guardian agree otherwise in writing. If a court finds any clause unenforceable, the rest remains in effect. This Part A, the booking confirmation, and the platform Terms of Use are the entire agreement for care of the listed Children.
A14. Parent / Legal Guardian signature
By signing, I confirm I am 18 or older, I am the parent or legal guardian of each Child listed, I have authority to sign, I have read Part A, and I agree to it.

PART B — Adult Terms (Adult Client and Adult Caregiver)
This Part B applies to every user who is 18 or older: (i) an adult who holds a family / Care Seeker account ("Account Holder"), and (ii) an adult who offers babysitting or nanny services ("Caregiver"). Parents signing Part A should also accept the platform portions of Part B as account holders. Minors cannot open a caregiver account. LKN Concierge does not place caregivers under 18 and does not accept bookings for care of any adult.
B0. Scope — children only
[NEW — Care.com gap closure] LKN Concierge is a childcare marketplace. Bookings for care of an adult — including companion care, senior care, disability support, post-operative care, respite care, or care for any adult who cannot fully consent for himself or herself — are outside the scope of the platform and are not permitted. Account Holders may only book care for minor children they are legally authorized to consent for. Caregivers may not accept, and Account Holders may not request, adult-recipient bookings through the platform. Requesting or accepting an adult-care booking is a material breach and grounds for immediate account termination. The Company disclaims all responsibility for any arrangement the parties nonetheless make for adult care, on or off the platform.
B1. Eligibility and accounts
You must be at least 18 years old and legally competent under North Carolina law (G.S. 48A-2).
You will provide accurate identity information. Caregivers must complete identity verification and the required background check and pay any disclosed activation fee.
You will not share your account. The Company may suspend accounts for safety, fraud, off-platform payment evasion, or policy violations.
Caregivers represent they are not a registered sex offender and that no resident of a home where they would provide a "baby sitting service" (G.S. 14-321.1) is a registered sex offender.
Work authorization and legal-name registration. Each Caregiver represents they are legally authorized to work in the United States and that the account is registered in the Caregiver's legal name. Each Care Seeker is responsible for verifying the age and work eligibility of any Caregiver they select and, for recurring engagements, for confirming Form I-9 documentation when required.
Prohibited-user representations. Caregivers further represent, and continue to represent for as long as they hold an account, that neither they nor any adult member of their household has ever been the subject of a conviction, deferred judgment, arrest with pending disposition, restraining order, or other legal action involving: any felony; theft; drug-distribution offenses; violence; physical, sexual, or emotional abuse; neglect; child endangerment; elder or vulnerable-adult abuse; fraud, dishonesty, or deception; registration (past or present) as a sex offender; or any offense involving endangering the safety of others. A material misrepresentation is a ground for immediate account termination and forfeiture of pending payouts to the extent lawful.
B2. Marketplace relationship — independent contractor
LKN Concierge is a technology and booking marketplace. It is not the employer of Caregivers, not a joint employer, and not a licensed child-care operator. Caregivers control whether to accept a booking, their rates (subject to any displayed platform rules), and how they perform care, so long as they meet these terms and applicable law. Caregivers are responsible for their own taxes, insurance, and (if they become a household employee of a family under IRS rules) any tax forms the family must issue. Occasional sitters are often independent contractors; recurring nannies may be household employees of the family — that is a family/caregiver tax issue, not a Company employment relationship.
Tax reporting. The Company facilitates payments only. Caregivers are responsible for reporting all income and for paying self-employment taxes. Where a Caregiver receives payments through the platform above the current IRS 1099-K reporting threshold, the Company or its payments processor may issue a Form 1099-K in accordance with then-current IRS rules. Care Seekers who engage a Caregiver as a household employee (IRS Publication 926) are responsible for W-2 issuance, FICA, and any required state filings.
Wage-and-hour, workers' comp, and unemployment disclaimer. The Company does not set Caregiver rates, hours, or schedules; does not track hours worked for wage-law purposes; and does not provide workers' compensation, unemployment insurance, disability insurance, or any employment benefit to any Caregiver. Compliance with the federal Fair Labor Standards Act (including its Domestic Service Final Rule) and the North Carolina Wage and Hour Act is the responsibility of the Care Seeker if an employment relationship forms, and of the Caregiver if the Caregiver is independent.
B4. Standards of conduct (all adults)
Treat children, families, and caregivers with respect. No harassment, sexual conduct involving a minor, intoxication on a job, or illegal drug use.
Keep communications about bookings on-platform so safety tools and records work.
Do not request or send intimate images. Do not contact a minor except through the Guardian's account.
Follow house rules. Do not bring unauthorized people to a booking.
Users must report safety incidents. The expectation is that every safety incident is submitted in the app as soon as reasonably possible, under Account, then Cases, or by email to hello@lkn-concierge.com if the user cannot sign in. Late is not a reason to stay silent. A safety report filed after 24 or 72 hours will still be accepted and reviewed. Do not refuse a safety report because it is late.
Additional prohibited conduct. Users must not: use the platform for any unlawful, fraudulent, harassing, defamatory, or obscene purpose; misrepresent identity or credentials; scrape, index, harvest, or bulk-download platform content, listings, or user data; probe, scan, or attempt to breach the Company's systems; upload malware; use the platform for staffing, recruiting, or commercial resale of caregiver labor; or use the platform to solicit adult-only services or content of any kind.
B5. Payments
Bookings are paid through Stripe Connect Express and, where used, Stripe Billing. The Company may collect a service fee. Caregivers receive payouts to their connected Stripe account after a completed booking, subject to holds for disputes. If this Policy or the Refund and Cancellation Policy requires the Caregiver to be paid for a family late cancel or family no-show, that cancellation pay is initiated as soon as the family is charged and should reach the Caregiver's connected Stripe account the same day or the next business day. Cancellation pay is not held until a later booking payout. If Stripe Connect is not yet live, the Company will still pay the Caregiver within two (2) business days of collecting the fee. Chargebacks initiated in bad faith may result in account suspension. Off-platform cash deals for platform-originated clients may result in removal.
Non-circumvention and liquidated damages. For a period of twelve (12) months after a Care Seeker and a Caregiver are first introduced through the platform, neither party may pay or receive payment for care services outside the platform for engagements that originated here. Because actual damages from off-platform circumvention are difficult to measure, each violating party agrees to pay the Company liquidated damages equal to the greater of (a) $500 per booking day performed off-platform or (b) twenty-five percent (25%) of the amount paid off-platform, plus reasonable collection costs and attorneys' fees. This clause is a bargained-for estimate, not a penalty.
Non-solicit of Company clients. During any active account and for twelve (12) months after account closure, a Caregiver will not solicit any Care Seeker they were introduced to through the platform to receive care services outside the platform. Nothing in this clause restricts a Caregiver from continuing an existing off-platform relationship that predates the platform introduction and that the Caregiver has disclosed in writing to the Company.
Subscription auto-renewal and refunds. Any recurring membership is billed automatically at the disclosed cadence until the user cancels in-app. Cancellation stops future billing but does not entitle the user to a refund of the current period unless required by law. Individual bookings are refundable only under the cancellation rules shown at checkout. Background-check fees are non-refundable once the report is initiated.
B6. Assumption of risk and release — adults
Adult Client and Caregiver each assume the ordinary risks of entering another person's home and providing or receiving non-medical household care.
TO THE MAXIMUM EXTENT PERMITTED BY NORTH CAROLINA LAW, each adult user releases the Company Parties from claims arising out of marketplace operations, including ordinary negligence in operating the platform. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, WILLFUL OR WANTON CONDUCT, OR INTENTIONAL MISCONDUCT, and does not release a Caregiver or a client from claims based on that person's own acts. THE COMPANY'S TOTAL LIABILITY TO ANY USER FOR PLATFORM-RELATED CLAIMS IN ANY TWELVE-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) FEES THAT USER PAID TO THE COMPANY IN THAT PERIOD OR (B) TWO HUNDRED FIFTY DOLLARS ($250), EXCEPT THAT THIS CAP DOES NOT APPLY TO LIABILITY THAT NORTH CAROLINA LAW DOES NOT ALLOW TO BE LIMITED.
No consequential or indirect damages. To the maximum extent permitted, the Company Parties are not liable for lost profits, lost wages, lost opportunities, loss of goodwill, emotional-distress damages arising solely from marketplace operations, or any indirect, incidental, special, consequential, exemplary, or punitive damages, even if the Company was advised of the possibility. This limitation applies regardless of the theory of liability (contract, tort, statute, or otherwise) and survives termination.
Shortened limitations period. Any claim a user has against the Company arising out of the platform must be filed within one (1) year after the claim accrued, or it is permanently barred, to the fullest extent North Carolina law allows the shortening of a limitations period.
B7. Indemnity
Each adult user will indemnify the Company Parties against third-party claims arising from that user's breach, misrepresentation, off-platform arrangements, or negligent or wrongful acts during a booking, except to the extent caused by a Company Party's gross negligence or willful misconduct.
B8. Insurance
Families should confirm that homeowners or renters liability coverage applies to guests and incidental household workers. Caregivers should consider their own renter's or personal liability coverage. The Company may offer or require platform insurance in the future; unless a certificate is issued to you, do not assume the Company insures in-home injuries.
B9. Intellectual property, reviews, and content
You grant the Company a license to display your profile, reviews, and booking communications as needed to operate the service. Reviews must be honest and not defamatory. The Company may remove content that violates these terms.
User-content license terms. The license you grant the Company is worldwide, royalty-free, sublicensable to the Company's service providers, and irrevocable to the extent needed to keep records, respond to safety incidents, comply with law, and operate the platform. You represent that you own or have rights to any content you post (including photos of your home, pets, or yourself) and that posting it does not violate any third-party right. Do not post images of another person's child or a vulnerable adult without written permission.
DMCA notice procedure. To report content that infringes your copyright, send a written notice under 17 U.S.C. § 512(c)(3) to LKN Concierge LLC, [PO BOX PLACEHOLDER — e.g., PO Box XXX, Mooresville, NC 28117], Attn: DMCA Agent, including your contact information, identification of the copyrighted work, the URL of the infringing content, a good-faith statement, and an electronic or physical signature. Counter-notices follow the same statutory format. Repeat infringers will be terminated.
B10. Dispute resolution
Before giving the 30-day written notice described below, a user must first use the appeal process in the Refund and Cancellation Policy and the Community Guidelines (in the app under Account, then Cases, or by email if the user cannot sign in). The Company will run that appeal and record the decision. Before filing a lawsuit, the parties will then try in good faith to resolve the dispute, including a 30-day written notice to the Company's registered office. If unresolved, either party may pursue mediation in Catawba County or a mutually agreed North Carolina county. This clause does not bar either party from seeking a temporary restraining order for safety, IP, or harassment issues. Jury trial waiver: each party waives a jury to the extent North Carolina law allows in a contract of this type. Class actions: users may bring claims only in an individual capacity.
Binding arbitration and class-action waiver (opt-out available). Except for the small-claims-court, injunctive-relief, and safety-emergency carve-outs below, any dispute, claim, or controversy arising out of or relating to the platform, these Terms, or a booking will be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Charlotte, North Carolina, before one arbitrator. The Federal Arbitration Act governs the interpretation and enforcement of this clause. The parties waive any right to a jury and any right to bring claims as a class, collective, or representative action. The arbitrator, not any court, decides threshold questions of arbitrability, except that a court decides the enforceability of the class-action waiver. Carve-outs: (i) either party may bring an individual claim in a North Carolina small-claims court within its jurisdictional limit; (ii) either party may seek emergency or injunctive relief in a state or federal court in Catawba County or the Western District of North Carolina to protect safety, intellectual property, or confidential information; and (iii) any claim that North Carolina or federal law forbids arbitrating is not covered. Opt-out: a user may opt out of this arbitration and class-waiver clause by sending written notice to LKN Concierge LLC, [PO BOX PLACEHOLDER — e.g., PO Box XXX, Mooresville, NC 28117], Attn: Legal, or by email to the address the Company designates, within thirty (30) days after first accepting these Terms. Opting out does not affect any other provision.
B11. Governing law
North Carolina law governs Part B, without regard to conflict-of-law rules. Venue is the same as in A13.
B12. Adult signature
By signing or tapping I Agree, I confirm I am 18 or older, I have read Part B, and I agree to it. If I am also a Guardian, Part A still governs care of my minor children.

Cross-cutting terms (apply to Parts A and B)
X1. Electronic communications and TCPA / SMS consent
By creating an account, you consent to receive electronic communications from the Company, including booking confirmations, safety alerts, service messages, and marketing messages. Where you provide a mobile number, you consent to receive calls and text messages from the Company or its agents at that number, including autodialed and prerecorded messages, for purposes covered by the federal Telephone Consumer Protection Act (47 U.S.C. § 227). Consent to marketing texts is not a condition of any purchase. Reply STOP to opt out of texts; standard message and data rates apply. You will keep your contact information current.
X2. Electronic signatures and records
Under the federal E-SIGN Act (15 U.S.C. § 7001 et seq.) and the North Carolina Uniform Electronic Transactions Act (G.S. Chapter 66, Article 40), you consent to sign, and to receive, contracts, disclosures, and records in electronic form. You may withdraw consent by closing your account. Paper copies are available on request for a reasonable fee.
X3. Modification of terms
The Company may update these Terms from time to time. Material changes will be posted in the app or emailed to the address on file at least fifteen (15) days before they take effect (except changes required by law or to address a safety risk, which may take effect immediately). Continued use of the platform after the effective date is acceptance. If you do not accept a change, your remedy is to stop using the platform and close your account.
X4. Account termination and effect
The Company may suspend or terminate any account at any time, with or without notice, for suspected violation of these Terms, safety concerns, fraud, off-platform payment evasion, chargeback abuse, or any legal reason. On termination, pending bookings may be cancelled, background-check fees are not refundable, and the sections that by their nature should survive (releases, caps, indemnity, arbitration, non-circumvention, non-solicit, IP license, confidentiality, and governing law) survive.
X5. Force majeure
The Company is not liable for failure or delay caused by events beyond its reasonable control, including natural disasters, severe weather, pandemic, government action, power or internet outages, third-party service failures (including Stripe or the background-check provider), and civil unrest.
X6. Assignment
You may not assign or transfer your rights or obligations under these Terms without the Company's written consent. The Company may assign these Terms to an affiliate, successor, or acquirer, or in connection with a merger, financing, or sale of assets.
X7. Entire agreement, severability, no waiver
These Terms, the booking confirmation, the Privacy Policy, and any product-specific addenda are the entire agreement between the parties on the subject and supersede any prior agreement. If any provision is found unenforceable, the rest remains in effect and the provision will be limited to the minimum extent necessary. No waiver of any term is a waiver of any other term or of any later breach.
X8. Multi-state notice (for future expansion)
If the Company later operates outside North Carolina, users in California, New York, Illinois, or other states may have additional rights (for example, California Civil Code § 1789.3 consumer-complaint notice and biometric-privacy statutes). Additional state addenda will be posted when service expands.
Have a North Carolina attorney licensed in this state review before launch. Ask counsel whether you want a standalone medical-authorization card that sitters can show to an ER, and whether the AAA arbitration clause needs an addendum for family-and-medical or consumer-protection carve-outs that N.C. courts have flagged.
